Limited Warranty: LVP & SPC Flooring Residential and Light Commercial Use

 

Section 1: Coverage Overview

This SPC Flooring or LVP Flooring product (the “Product”) is protected by the following limited warranties (the “Limited Warranties”) applicable solely to the End User (as defined in Section 2) for Residential Use (as defined in Section 2) or Light Commercial Use (as defined in Section 2). These Limited Warranties are non-transferable. To remain valid, the installation, use, and maintenance of the Product must adhere to the manufacturer’s guidelines.

Limited Warrantied Period (the “Warranty Period”)

The Product is protected by the Limited Warranties for the time periods as outlined in below table.

Limited Manufacturing Defect Warranty

RYCOOKS LLC warrants the Product in its original condition to be free from defects in materials and craftsmanship, including any issues with dimensions or grading, for one (1) year from the purchase date.

Limited Residential Wear Warranty

RYCOOKS LLC guarantees against the wear-through (as defined in Section 2) of the top wear layer due to typical foot traffic from normal Residential Use and ensures the substrate layer remains covered. This protection lasts for the full Residential Warranty Period.

Limited Light Commercial Wear Warranty

RYCOOKS LLC guarantees against the wear-through of the top wear layer due to typical foot traffic from Light Commercial Use and ensures the substrate layer remains covered. This protection lasts for the full Light Commercial Warranty Period.

Limited Residential Waterproof Warranty

RYCOOKS LLC warrants the Product to be waterproof (as defined in Section 2) and warrants against damage to its structural integrity from surface water exposure under normal Residential Use during the Residential Warranty Period.

Limited Residential Structural Integrity Warranty

RYCOOKS LLC guarantees that the Product will maintain its layer cohesion and structural stability under normal Residential Use during the Residential Warranty Period.

 

Section 2: Definitions

  • End User: An individual, business, or entity that acquires the Product directly from an authorized distributor or retailer for the purpose of installation or final use in a Residential Use or Light Commercial Use setting. The End User is not a party who purchases the product for resale or distribution.
  • Residential Use: The End User privately owns and occupies the residence where the Product is installed (excluding rental properties).
  • Light Commercial Use: Low-moderate foot traffic areas, such as rental or leased properties, salons, jewelry or watch stores, studios, boutiques, common areas, lounges (excluding service areas), conference rooms, and waiting areas.
  • Full Commercial Use: High-impact or high-traffic areas, such as airports, supermarkets, restaurants, and schools. The Product is not protected by any of the Limited Warranties if any part of the installation is in an area deemed as Full Commercial Use.
  • Wear-through: Visible exposure of the substrate layer on 10% or more of the Product installation, from normal or regular Residential Use or Light Commercial Use.
  • Waterproof: Resistance to water damage without structural compromise.
  • Structural Integrity: The stability and cohesion of the composite layers of the Product, which will remain intact when installed and cared for according to the manufacturer’s instructions during the Warranty Period of the Product. The attached backing or pad (IXPE, EVA, or other foam material) is not part of the composite unit and is therefore not covered under the Structural Integrity protection.
  • Pet Resistant: The Product will not be stained by dog or cat urine as long as the urine is cleaned within a reasonable amount of time.

 

Section 3: Warranty Resolution

If a warranty claim is submitted and accepted by RYCOOKS LLC, RYCOOKS LLC will arrange for resolution with the original purchaser according to the below schedule.

For Residential Use:

  • Within Year 1: Full replacement or repair of the Product, including reasonable labor costs for professionally installed floors.
  • Years 1–5: Full replacement or repair of the Product, including coverage for 50% of the reasonable labor costs for professionally installed floors.
  • Years 5–10: Full replacement or repair of the Product only, with no coverage for any potential labor costs incurred for professional installation.
  • Remainder of Residential Warranty Period: RYCOOKS LLC will provide replacement Product to repair the defective areas of the floor, with no coverage for any potential labor costs incurred for installation; discontinued items will be replaced with comparable alternatives.

For Light Commercial Use:

  • Within Year 1: Full replacement or repair of the Product, including reasonable labor costs for professionally installed floors.
  • Years 1–2: Full replacement or repair of the Product, including coverage for 50% of the reasonable labor costs for professionally installed floors.
  • Remainder of Light Commercial Warranty Period: RYCOOKS LLC will provide replacement Product to repair the defective areas of the floor, with no coverage for any potential labor costs incurred for installation; discontinued items will be replaced with comparable alternatives.

 

Section 4: Warranty Conditions

The Limited Warranties apply only if the following conditions are met:

  1. Installation follows the manufacturer’s guidelines and is for flooring purposes only.
  2. The Product is used indoors in a dry, climate-controlled environment.
  3. Maintenance is performed as outlined in the care instructions.
  4. Uses other than the Product’s original intended purposes are not covered by this warranty. This includes, but is not limited to, usage on any moving vehicles or installation on walls or ceilings.
  5. Visible defects must be addressed before installation. Defective Product should not be installed and instead should be returned to RYCOOKS LLC as defective material.
  6. Manufacturing defects covered under the Limited Warranties must be found in more than 5% of the total area or installation of a project when installed in a typical horizontal arrangement. In the case of a diagonal installation, manufacturing defects covered under the Limited Warranties must be found in more than 10% of the total area or installation of a project.

 

Section 5: Exclusions

The Limited Warranties do not cover, and RYCOOKS LLC will not accept warranty claims against the Product for any of the following situations or reasons:

  • Discoloring from light exposure. The decorative layer of the Product is resistant to color changes from light exposure. However, light exposure will eventually affect the appearance of the Product, depending on intensity of light and length of exposure. RYCOOKS LLC does not warrant against any change in appearance of the Product due to light exposure.
  • RYCOOKS LLC will not warrant against variations between samples, photos, or models and the installed Product. Any samples, photos, or models are for demonstrative purposes only.
  • Damage from direct sunlight, extreme heat, or improper climate control.
  • Installation in non-standard areas (e.g., outdoors, boats, vehicles).
  • Mold, mildew, or water damage from subfloor issues or standing water.
  • Surface scratches, dents, or damage caused by heavy objects or improper care.
  • Damage from natural or man-caused disasters, or other damages which are usually covered by homeowners insurance.
  • Damage from cleaning machines, including steam cleaners.
  • Damage from improper installation.
  • Damage from any abuse such as moving heavy objects or appliances across the Product without adequate protection.
  • Damage from wheels, including but not limited to, chairs, desks, or beds.
  • Water damage to surrounding areas attached to the Product. The Product is waterproof but should not be used as a waterproofing agent for other surfaces.
  • Any noise including but not limited to squeaking, popping, or scratching.
  • Any deformities that are not measurable or only visible under certain conditions. Visible defects will be evaluated by visibility under normal lighting conditions and standing positions.
  • Recoating, refinishing, or alterations of any kind.
  • Product that has already been replaced by a previous warranty claim.
  • Product that has already been installed, subsequently uninstalled from its original installation, and then re-installed for any reason.
  • Incidental and/or consequential damages, including but not limited to any losses, expenses, or damages resulting from a defect in the Product. Examples include hotel accommodation because of needing to replace the Product, or costs associated with moving furniture as a result of replacing the Product.
  • Any products sold “As-is”, “close-out”, or “non-standard”.

 

Section 6: Claims Process

To file a claim, contact the retailer or distributor where the Product was purchased with proof of purchase and details of the issue. RYCOOKS LLC reserves the right to inspect the Product and request samples for evaluation. RYCOOKS LLC also reserves the right to deny a warranty claim if, in its sole discretion, it determines that the claim is fraudulent, misleading, or otherwise made in bad faith. RYCOOKS LLC reserves the right to pursue legal remedies, including claims for damages, against any individual or entity found to have intentionally submitted a false or fraudulent warranty claim.

Manufacturer’s Responsibility:

If a claim is approved, RYCOOKS LLC will repair or replace the affected Product. For professional installations, reasonable labor costs may be reimbursed according to the terms as outlined in this document. If repair or replacement is not feasible, a refund of the original material cost will be provided.

Limitation of Liability:

RYCOOKS LLC is not responsible for incidental or consequential damages, such as costs associated with removing or replacing surrounding fixtures or furniture. Warranty remedies are limited to those stated above. Rights may vary by state.

 

Section 7: Other Terms and Conditions

RYCOOKS LLC reserves the right to modify, amend, or update these Limited Warranties at any time, for any or no reason, and without prior notice. Any changes to the Limited Warranties will be effective immediately upon posting to RYCOOKS LLC’s website or distribution through other official communication channels. Buyers are encouraged to review the Limited Warranties regularly to stay informed of any updates.
